§ 1. Definitions

The terms used in these Terms of Service shall have the following meanings:

  • Service Provider – JWeb Jonasz Walasik, ul. Ignacego Daszyńskiego 11 lok. 43, 95-070 Aleksandrów Łódzki, Poland, NIP: 7282650504, REGON: 528537910.
  • Service / Application – the online platform available at fider.in, enabling the creation, scheduling, and publishing of social media content.
  • User – a natural person with full legal capacity (aged 18 or over), a legal person, or an organisational unit without legal personality, who has entered into an Agreement with the Service Provider.
  • Consumer – a User who is a natural person using the Service for purposes not directly related to their business or professional activity.
  • Trader with Consumer Rights – a User who is a natural person conducting business activity, for whom the Agreement is not of a professional nature.
  • Account – the individual account created in the Service upon registration.
  • Free Account – an Account without an active paid subscription, with access to a limited set of Service features and a one-time pool of starter Credits.
  • Plan – a type of paid subscription (Hobby, Pro, Ultimate) defining the scope of available features, integrations, and the number of Credits renewed each month.
  • Credits – billing units used to access AI features (content generation, image generation, animation). A distinction is made between Plan Credits (allocated under the Plan and reset each month) and Starter Credits (a one-time, non-renewable pool for new Accounts).
  • User Content – all materials (texts, graphics, photos, videos) uploaded, generated, or published by the User through the Service.
  • Third-Party AI Providers – third-party entities providing artificial intelligence model services used by the Service (including Nano Banana, Seedreams, Veo, and others), subject to those providers’ own terms.
  • Social Media Platforms – external social media services (Facebook, Instagram, TikTok, YouTube, LinkedIn) with which the Service enables integration.
  • Template – a ready-made animated reel layout constituting the intellectual property of the Service Provider, made available to the User under the applicable Plan.
  • Output – the final result of the User’s work in the Service (post, graphic, reel), which is owned by the User.
  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

§ 2. General Provisions

1. These Terms of Service govern the provision of electronic services by the Service Provider through the fider.in Service.

2. These Terms of Service are made available free of charge at fider.in/en/terms in a manner that allows them to be downloaded, saved, and printed.

3. Use of the Service requires a device with Internet access and a JavaScript-enabled web browser.

4. The Service Provider provides electronic services within the meaning of the Polish Act of 18 July 2002 on the Provision of Electronic Services.

5. Creating an Account requires acceptance of these Terms of Service and the Privacy Policy.

6. The Service Provider reserves the right to amend these Terms of Service. Users with an active Account will be notified of any amendment by email at least 14 days in advance. An amendment does not affect rights acquired by Users for periods for which they paid before the amendment’s effective date. If a User does not accept the changes, they may terminate the Agreement with effect at the end of the current billing period. Continued use of the Service after the notice period expires constitutes acceptance of the changes.

§ 3. Registration and User Account

1. Use of the Service’s features requires creating an Account.

2. Registration is available only to persons aged 18 or over.

3. The User is required to provide accurate and up-to-date information during registration.

4. The User is solely responsible for maintaining the confidentiality of their Account credentials and for all activities carried out using their Account.

5. The Service Provider may suspend or delete an Account in the event of a breach of these Terms of Service, provision of false information, or action detrimental to the Service Provider or other users. The User will be notified of the suspension immediately by email, stating the reason.

A User with an active paid subscription may object to a suspension decision within 14 days of receiving the notification by contacting helpdesk@fider.in.

Access to the Service may remain suspended until the objection has been reviewed.

6. The User may delete their Account at any time by submitting a request to helpdesk@fider.in. Account deletion does not entitle the User to a refund for any unused portion of the subscription period, subject to § 10 regarding the right of withdrawal.

§ 4. Free Account and Starter Credits

1. Registration with the Service is free. Upon creating an Account, the User gains access to a Free Account with a limited set of features.

2. Each new Account receives a one-time pool of Starter Credits. The number of Starter Credits is specified within the Service and may be changed by the Service Provider.

3. Starter Credits do not renew and are not carried over to subsequent periods. They cannot be withdrawn or exchanged for monetary value.

4. Once Starter Credits are exhausted, access to AI features is available only under an active paid Plan or following the purchase of additional Credits.

5. The Service Provider reserves the right to modify the scope of features available on the Free Account at any time.

§ 5. Subscription and Payments

5.1. Nature of the Agreement

1. The Agreement for the provision of services under a paid Plan (subscription) is concluded for an indefinite term with a monthly billing period.

2. The Agreement is concluded at the moment the first payment for the selected Plan is successfully processed.

3. The scope of features and integrations available under each Plan is set out on fider.in and within the Service. The Service Provider reserves the right to modify the scope of Plans in accordance with the procedure described in § 2(6).

5.2. Plan Activation

1. Activation of a paid Plan requires the User to provide payment details and confirm acceptance of these Terms of Service and acknowledgement of the Privacy Policy. By activating the Plan, a User who is a Consumer expressly consents to the immediate commencement of the digital service, which constitutes the basis for excluding the right of withdrawal pursuant to Article 38(13) of the Polish Consumer Rights Act.

2. The gross price of the Plan is presented to the User before payment is made.

3. Payments are processed through the third-party payment operator Stripe, Inc. Payment card data is not stored by the Service Provider.

5.3. Automatic Renewal

The subscription renews automatically each month. The charge is applied to the User’s payment card before the start of the next billing period. The User may cancel the subscription before the next renewal date – cancellation results in access being retained until the end of the paid period, with no further charges.

IMPORTANT: The subscription renews automatically each month. To avoid the next charge, cancel your subscription in Account Settings before the renewal date.

5.4. Cancellation

1. The User may cancel their subscription at any time through Account Settings within the Service.

2. Cancellation does not result in immediate termination of services – access to the Service continues until the end of the paid billing period.

3. The Service Provider does not issue refunds for any unused portion of the subscription period, except as described in § 10 (right of withdrawal) or where mandatory provisions of law require otherwise.

5.5. Plan Changes

1. Upgrade (switching to a higher Plan):

  • the change takes effect immediately,
  • the price difference for the remaining portion of the current period is settled automatically – the additional charge equals the pro-rated price difference for the remaining days of the current billing period (e.g. upgrading on day 15 of a 30-day period results in a charge for 15 days’ worth of the price difference between the Plans),
  • Plan Credits are topped up by the difference between the new and old Plan’s credit pools.

2. Downgrade (switching to a lower Plan):

  • the change takes effect from the start of the next billing period,
  • the User retains all current features, integrations, and Credits until the end of the current period,
  • from the next billing period, the Credit limits and features of the new Plan apply,
  • scheduled publications on platforms not available under the new Plan may be cancelled, and the associated social media connections may be disconnected.

5.6. Price Changes

The Service Provider reserves the right to change Plan prices. Users with an active subscription will be notified of any price change by email at least 30 days before the next renewal. If a User does not accept the new price, they may cancel their subscription at no additional cost, with effect at the end of the current paid period. Continued use of the subscription after the new price comes into effect constitutes acceptance of the change.

5.7. Invoices

Invoices are generated automatically and sent to the User’s email address after each successful payment. The User may provide VAT invoice details in Account Settings.

§ 6. Credits

1. Credits are billing units consumed when using AI features: text content generation, image generation, image editing, and photo-to-video animation.

2. The number of Plan Credits allocated under each Plan is specified on fider.in and within the Service.

3. Plan Credits are reset to the full pool of the current Plan upon each monthly subscription renewal. Unused Plan Credits do not carry over to the next period.

4. Credits purchased additionally outside of the subscription are not reset upon subscription renewal.

5. The User can check their current Credit balance within the Service.

6. Credits cannot be exchanged for monetary value or refunded, except as described in § 10 (right of withdrawal) or where mandatory provisions of law require otherwise.

7. The Service Provider reserves the right to change the number of Credits allocated to each Plan, with at least 30 days’ prior notice to Users.

§ 7. User Content and Intellectual Property

7.1. Responsibility for Content

1. The User bears sole and full responsibility for all User Content uploaded, generated, or published through the Service, including its compliance with applicable law, third-party rights, and the rules of the relevant Social Media Platform.

2. The User represents and warrants that:

  • they hold all necessary rights (including economic copyrights, image rights, and any required third-party consents) to the materials uploaded to the Service,
  • such materials do not infringe any intellectual property rights, personal rights, or other rights of third parties,
  • such materials comply with applicable law and the rules of the Social Media Platform on which they will be published.

3. The User acknowledges that the Service uses artificial intelligence systems to generate and modify content and graphics. AI-generated Output constitutes a proposal that requires human review before publication – the User bears sole responsibility for the content and consequences of every publication.

4. Pursuant to Article 50 of Regulation (EU) 2024/1689 (AI Act), the User is required to appropriately label synthetic content (in particular videos and graphics containing synthetic likenesses of persons) where such an obligation arises under applicable law.

5. Use of the Service to create so-called deepfakes – that is, synthetic video or graphic materials depicting the likeness of real persons without their explicit consent, in particular for disinformation, misleading, or personal-rights-infringing purposes – is strictly prohibited. The Service Provider is entitled to immediately remove such content and suspend the Account of the User responsible for its creation.

6. The Service Provider does not carry out preventive review of User Content for compliance with law or third-party rights. The Service acts as a hosting provider within the meaning of digital services regulations and benefits from the limitation of liability for content stored at the User’s request, provided it acts expeditiously upon obtaining credible notice of the unlawfulness of such content.

7. Upon obtaining credible information that User Content infringes the law or third-party rights, the Service Provider is entitled to immediately remove or disable access to such content without prior notice to the User.

8. Any third-party claims directed against the Service Provider in connection with User Content shall be borne exclusively by the User. The User undertakes to cover all costs, including legal costs, incurred by the Service Provider in connection with such claims.

7.2. Processing of Materials by Third-Party AI Providers

1. Fider acts as a technical intermediary (orchestrator) in the process of AI-based content processing. The Service transmits the User’s materials to Third-Party AI Providers solely at the User’s request and for the purpose of performing the requested operations (generation, animation, editing).

2. All modifications to the content of materials are made exclusively by Third-Party AI Providers and not on the Service Provider’s servers.

3. The Service may perform only technical operations on finished files returned by Third-Party AI Providers – such as cropping to adjust the aspect ratio to template requirements – without altering the visual content of the material.

4. The Service Provider shall not be liable for the actions, decisions, errors, or results of Third-Party AI Providers, including the quality, accuracy, or lawfulness of AI-generated Output, nor for changes in the operation or availability of Third-Party AI models.

5. The User acknowledges that materials uploaded by them may be transferred to Third-Party AI Providers located outside the European Economic Area, in accordance with the Privacy Policy.

7.3. Ownership and License

1. Reel Templates are the intellectual property of the Service Provider. The User is granted a non-exclusive, non-transferable licence to use the Templates solely within the Service and solely for the duration of the active subscription that entitles access to the given Template.

2. Output (the final post, graphic, or reel) produced by the User using the Service – including Templates – is owned by the User. The Service Provider makes no claim to any Output.

3. The User may use the Output for commercial and non-commercial purposes, including publishing it on Social Media Platforms.

4. The User grants the Service Provider a royalty-free, limited licence to store and technically process User Content solely to the extent necessary to provide the Service.

§ 8. Social Media Integrations

1. Fider enables integration with Social Media Platforms through their official APIs. The availability of individual Platforms depends on the active Plan.

2. The Service Provider shall not be liable for:

  • interruptions, outages, changes in functionality, or changes in the terms of use of a Social Media Platform’s API,
  • blocks, suspensions, or deletions of the User’s accounts by Platform operators,
  • failed or delayed publications resulting from the action or omission of a Platform,
  • changes in a Platform’s algorithms affecting the reach or visibility of content.

3. The User uses Social Media Platforms in accordance with their respective terms of service and bears sole responsibility for compliance with their rules.

4. The Service Provider does not store passwords to the User’s accounts on Social Media Platforms.

§ 9. Liability

1. The Service Provider undertakes to provide services with due care and to take measures aimed at ensuring the continuity of the Service.

2. The Service Provider excludes its liability to the fullest extent permitted by law, and in particular shall not be liable for:

  • AI-generated content – such content constitutes a proposal for the User only; the User independently decides how to use it and bears full responsibility for its publication and all consequences thereof,
  • the compliance of User Content with applicable law or third-party rights,
  • interruptions in the provision of services arising from causes attributable to Third-Party AI Providers or Social Media Platforms,
  • temporary unavailability of the Service caused by maintenance work, infrastructure failures, or force majeure events,
  • damage resulting from the User providing false information, from unauthorised access to the User’s Account, or from the actions of third parties,
  • loss of data caused by the User’s actions or by circumstances beyond the Service Provider’s control.

3. In relationships with Users who are not Consumers, the Service Provider excludes liability for lost profits and indirect damages, and the total liability of the Service Provider towards such a User shall not exceed the sum of fees paid by that User in the 3 months preceding the event giving rise to the damage.

4. The limitations and exclusions of liability set out in paragraphs 2 and 3 do not apply to Consumers to the extent that mandatory provisions of law do not permit such exclusion – in those cases, statutory provisions shall apply.

§ 10. Right of Withdrawal

1. A Consumer who has concluded a distance contract has the right to withdraw from it within 14 days from the date of conclusion of the Agreement (i.e. from the date of the first successful payment for the Plan), without giving any reason.

2. A withdrawal notice must be submitted electronically to helpdesk@fider.in before the deadline referred to in paragraph 1. It is sufficient to send the notice before the deadline expires.

3. In the event of a valid withdrawal, the Service Provider shall refund to the Consumer all payments received from them promptly, no later than 14 days from the date of receipt of the withdrawal notice, using the same payment method used by the Consumer.

4. The right of withdrawal does not apply to the Consumer in respect of subsequent automatic subscription renewals following the first paid billing period. The basis for this exclusion is Article 38(13) of the Polish Consumer Rights Act – the digital service is fully performed at the moment the User is granted access to the Plan for the given billing period, with the Consumer’s express consent given by activating the subscription with automatic renewal.

5. The right of withdrawal described in this section applies exclusively to Consumers and Traders with Consumer Rights. Users conducting business activity who acquire the service in connection with that activity are not entitled to withdraw from the Agreement on consumer terms.

§ 11. Complaints

1. The User may submit a complaint regarding the services provided electronically to: helpdesk@fider.in.

2. A complaint should include:

  • the email address associated with the Account,
  • a description of the issue and the circumstances in which it occurred,
  • the User’s request.

3. The Service Provider shall process the complaint and provide a response within 14 calendar days of its receipt. Where additional investigation is required, this period may be extended – the User will be informed accordingly.

4. The response to a complaint is sent to the email address provided in the submission.

5. The Consumer has the right to use out-of-court complaint resolution and redress procedures, including submitting a request to the European Online Dispute Resolution Platform: https://ec.europa.eu/consumers/odr.

6. Pursuant to Article 16 of Regulation (EU) 2022/2065 (Digital Services Act), third parties who believe that content stored in the Service is unlawful may report this to helpdesk@fider.in, with “DSA Report” in the subject line of the message. The report should include: a description of the content and the reason it is considered unlawful, the location of the content (e.g. a link or description), and the contact details of the reporting party. The Service Provider shall process reports without undue delay and inform the reporting party of the action taken.

§ 12. Data Protection

The rules governing the processing of Users’ personal data are set out in the Privacy Policy available at fider.in/en/privacy, which forms an integral part of these Terms of Service.

§ 13. Final Provisions

1. These Terms of Service enter into force on 20 March 2026.

2. Matters not governed by these Terms of Service shall be subject to Polish law, in particular the Civil Code, the Act on the Provision of Electronic Services, and the Consumer Rights Act.

3. Any disputes arising from these Terms of Service shall be resolved by the court having territorial and subject-matter jurisdiction in accordance with the Code of Civil Procedure. For Consumers, the competent court is determined by statutory provisions, in particular the court of the Consumer’s place of residence. The choice of Polish law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence (Article 6(2) of the Rome I Regulation).

4. If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted.

5. The Polish language shall govern the interpretation of these Terms of Service.
